These Terms of Use (“Terms”) govern your use of the Lotus Love app for iPhone and Apple Watch, including its widgets (the “App”), provided by Lotus L (individual developer; “we”, “us”, “our”). By installing, accessing, or using the App, you agree to these Terms.

1. Acceptance

By installing or using the App, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, please do not use the App, or uninstall it if already installed.

2. Eligibility

The App contains mature content and is intended for adults aged 18 or older. By using the App, you confirm that:

You are at least 18 years old
You are legally able to enter into a binding agreement
Your use of the App complies with the laws that apply to you

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, for personal, non-commercial use only, subject to these Terms and Apple’s Media Services Terms and Conditions.

4. Subscriptions and In-App Purchases

The App offers auto-renewable subscriptions and one-time purchases.

4.1 Auto-Renewable Subscriptions

Options: Lotus Pro Monthly and Lotus Pro Yearly
Payment: charged to your Apple Account when you confirm the purchase
Auto-renewal: your subscription renews automatically unless you turn off auto-renewal at least 24 hours before the end of the current period
Renewal charge: your account is charged within 24 hours before the end of the current period
Managing: you can manage or cancel your subscription at any time in your Apple Account settings
Refunds: refunds are handled by Apple under its policies and applicable law

4.2 One-Time Purchases

Lifetime Pro: permanent access to Pro features
Content packs: permanent access to the purchased content
Refunds are handled by Apple under its policies and applicable law

4.3 Prices

Prices are shown in the App and on the App Store. If a subscription price changes, you will be notified in advance as required by Apple.

4.4 Free Trials and Introductory Offers

We may offer a free trial or introductory price. Eligibility is determined by Apple. Unless you cancel at least 24 hours before the trial or offer ends, your subscription continues at the regular price. If you subscribe during a free trial, any remaining trial time ends.

4.5 Pro Content and Features

Some content and features are available only with Lotus Pro. If your Pro access ends, these are locked again, but your records, data, and settings are kept and become available again if you resubscribe.

5. Restore Purchases

You can restore purchases made with the same Apple Account using “Restore Purchases” in the App.

6. Acceptable Use

You agree not to:

Copy, modify, reverse engineer, or extract any part of the App or its content
Resell, rent, sublicense, or otherwise transfer your access to the App
Access the App by automated means
Use the App to harass, harm, or endanger yourself or others
Use the App in violation of any applicable law

6.1 Respecting Others

Only add, record, or share information about another person, including a partner, with their consent.
Before using recording features, make sure everyone present agrees. Laws on recording differ by location, and you are responsible for following them.
Only share items with people who want to receive them, and do not forward or misuse items others share with you.

7. Content Notice

Content, plans, and suggestions in the App are for adults and are provided for general information and entertainment only. Any activity should take place only between consenting adults. The App does not provide medical, psychological, or relationship advice.

Heart rate, activity, and other values shown in the App are estimates and may not be accurate. Do not rely on them for medical purposes.

8. Health Notice

The App is not a medical device and does not replace professional advice. If you have questions about your health or wellbeing, please consult a qualified professional.

Cycle predictions in the App are estimates only and must not be used for birth control or family planning.

9. Intellectual Property

The App and its content, including text, illustrations, design, and trademarks, belong to Lotus L or its licensors. You may not copy, distribute, or use them commercially without our written permission. The records and notes you create belong to you.

10. Termination

You can stop using the App at any time by uninstalling it. We may suspend or end your access if you violate these Terms. This does not entitle you to a refund except as required by Apple’s policies or applicable law.

11. Disclaimers

The App is provided “as is” and “as available”, without warranties of any kind to the extent permitted by law. We do not guarantee that the App will be uninterrupted or error-free. We may add, change, or remove content and features over time.

11.1 Your Data

Your data is stored on your devices and, if you choose, in your own iCloud. We cannot access or recover it for you. Please keep your devices, iCloud account, and backups safe. Backup passwords cannot be recovered, and audio recordings and cycle data are not included in backups.

12. Limitation of Liability

To the maximum extent permitted by law, Lotus L is not liable for any indirect, incidental, special, or consequential damages, or for loss of data, arising from your use of the App. Our total liability for any claim related to the App will not exceed the amount you paid for the App in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

13. Indemnification

You agree to indemnify Lotus L against claims arising from your violation of these Terms, your misuse of the App, or your sharing of information about others without their consent.

14. Changes to These Terms

We may update these Terms. When we make material changes, the App will ask you to review and accept the updated Terms before you continue. If you do not agree, please stop using the App.

15. Governing Law

These Terms are governed by the laws of Lotus L’s place of residence, without regard to conflict-of-law rules. This does not affect any rights you have under the mandatory consumer protection laws of your country.

Purchases made through the App Store are also subject to Apple’s terms. Apple is not a party to these Terms and is not responsible for the App.
